Ndara B Community and Diaspora Kenyans who are founding and developing Diaspora University Town project in Taita Taveta are doing so in accordance with the Kenya Constitution. The community and Diaspora Kenyans are following the Constitution as well as implementing it. The following 10 constitutional laws and statements are founding Diaspora University Town (DUT.)

  1. Kenya Constitution 1. (1) All sovereign power belongs to the people of Kenya and shall be exercised only in accordance with this Constitution.

Ndara B Community Members and Diaspora Kenyans hold the power of their land and their human resource as their Sovereign Power that they shall apply in accordance with Kenya Constitution.

  1. Kenya Constitution 1. (2) The people may exercise their sovereign power either directly or through their democratically elected representatives.

Ndara B Community Members and Diaspora Kenyans are exercising their power directly by putting their land, human resource and cash into productive and sustainable use.

  1. Kenya Constitution 2. (1) This Constitution is the supreme law of the Republic and binds all persons and all State organs at both levels of government.

Ndara B Community members and Diaspora Kenyans are exercising their sovereign power with consideration that Kenya Constitution is the Supreme Law.

  1. Kenya Constitution 19. (3) The rights and fundamental freedoms in the Bill of Rights— (a) belong to each individual and are not granted by the State.

Ndara B Community members and Diaspora Kenyans rights, as written in the Kenya Constitution Bill of Rights, that include the property, environment, economic, social and children rights, among others, belong to them as individuals and collectively. These rights are not granted by the State through state officers.

  1. Kenya Constitution 26. (1) Every person has the right to life.

Ndara B Community members and Diaspora Kenyans every day are working and striving to make their land resource, human resource and cash productive to achieve their right of life for themselves and others every day.

  1. Kenya Constitution Every person has the right to a clean and healthy environment.

Ndara B Community members and Diaspora Kenyans when developing Diaspora University Town are also implementing a clean and healthy environment plan that includes planting of trees.

  1. Kenya Constitution 43.(1) Every person has the right—  (a) to the highest attainable standard of health, which includes the right to health care services, including reproductive health care; (b) to accessible and adequate housing, and to reasonable standards of sanitation; (c) to be free from hunger, and to have adequate food of acceptable quality; (d) to clean and safe water in adequate quantities; (e) to social security; and (f) to education. (2) A person shall not be denied emergency medical treatment.

Ndara B Community members and Diaspora Kenyans are applying their land, human and cash resources to achieve economic and social rights for themselves and others.

  1. Kenya Constitution 60. (1) Land in Kenya shall be held, used and managed in a manner that is equitable, efficient, productive and sustainable.

Ndara B Community members shall use their land productively and through sustainable plans to achieve their rights.

  1. Kenya Constitution 185 (4) The county assembly may receive and approve plans and policies for— the management and exploitation of the county’s resources; and the development and management of its infrastructure and institutions.

Ndara B Community and Diaspora Kenyans are applying their resources to enact an Institution Town Development Plan approved by the County Assembly in accordance with Kenya Constitution 185 (4).

  1. Kenya Constitution 209. (1) Only the national government may impose— (a) income tax;  (b) value-added tax; (c) customs duties and other duties on import and export goods; and (d) excise tax. (3) A county may impose— (a) property rates; (b) entertainment taxes; and (c) any other tax that it is authorised to impose by an Act of Parliament.

Ndara B Community and Diaspora Kenyans by making their land, human and cash resources productive are paying taxes that are funding of the National and County Government.
